Grounds For Divorce

In April 2022, the law in respect of divorce changed.  There is now only one ground for divorce which is the irretrievable breakdown of the marriage.

Contrary to previous law, it is not necessary anymore to state a “fact” to be relied upon such as "unreasonable behaviour". The Applicant(s) will now only need to confirm by way of statement that there has been an “irretrievable break down in the marriage”.  The Court must then take this statement to be conclusive evidence that the marriage has irretrievably broken down and make a divorce order.
